Channel Sales

The following Terms and Conditions are applicable for channel partners, dealers, system integrators and any other clients who procure products and services from us at dealer pricing and further participate in the re-sale of these products and services.

1) Payment Terms: 100% Advance. Credit Facility available based on transaction history and approval of documentation. Please discuss with your authorised account manager.

2) Pricing is inclusive of applicable taxes. Shipping and Insurance extra as quoted or as per actual.

3) Product Warranty: 1 year or as per manufacturer. Conduits, Wires, Cables, Batteries and Consumable are not under warranty.

5) This quote is a best estimate only. We design solutions and make best efforts to incorporate all your requirements into the solution being presented here. While the products listed are quality checked through peer and senior reviews, the quantities might vary based on site conditions or changing requirements through the project life-cycle. Servicing charges are a best estimate only and actual servicing will be billed regularly through the project on a weekly basis as per actual work done. Kawach offers no servicing warranty for our partners and servicing can only be provided where possible based on discussions with your account manager.

6) Pricing is valid till quote expiry date only. Items purchased / shipped beyond this date will be billed at the pricing at the time. Expect minor variations due to inflations and changing forex rates.

7) Settlement: Supplied goods remain property of Kawach Protection Systems Pvt. Ltd. till full and final invoiced amount is cleared. All disputes if any are subject to Gurgaon Jurisdiction only.

Support Services

The following Terms and Conditions are applicable for our after-sales support services. These are also mentioned on copies of invoices issued during support services.

  1. The Customer must insist for a support invoice signed by an authorized Kawach support provider upon completion of all work. The invoice will contain charges for servicing, any products sold or acknowledgement for products taken back for repairs. No products shall be replaced, exchanged or returned without authorized and official invoicing.
  2. The principal responsibility for Guarantee / Warranty shall be borne by the original equipment manufacturing (OEM) company and Kawach only helps facilitate the repair / replacement process. If any goods are supplied as “Kawach” branded then these are warranted for a period of 12 months from the date of invoice. Components like batteries, wiring, conduiting and any other consumables used to install and interconnect electronic device are not under any warranty.
  3. After project completion, Kawach automatically enrolls clients to our Bronze AMC plan for a period as agreed upon in our final quote for the systems procured. The Bronze AMC plan is there to provide a servicing warranty for the systems provided and this starts from the date of our official system handoff at site.
  4. The Company shall have the right to retain the components replaced under Warranty / Contract (AMC/CMC).
  5. AMC / CMC contract fee is likely to increase over time due to inflation and rising costs of servicing. Also any contracts renewed will be based on the then present total value of the system(s) being taken up under contractual maintenance.
  6. For any systems not under warranty or contractual maintenance (AMC / CMC) service charges will be applicable at a rate of Rs 500/- for the first hour of service and Rs 200/- for every additional half an hour of servicing provided. The minimum rate shall be Rs 500/- to cover transportation and visitation expenses. The daily maximum shall be limited to Rs 3000/-. All amounts mentioned on the invoice include all applicable taxes.
  7. The AMC/CMC fee shall be charged in lump sum (100% Advance) and no refund shall be claimed by the Customer for its termination abruptly.
  8. All AMC / CMC Plans offer unlimited visits for system malfunction and breakdown as per plan details. However only a maximum of 12 visits will be allowed in a year for software re-configurations, trainings and battery replacements to take care of clients changing requirements from time to time.
  9. The liability of the Company is restricted only to defects which occur under conditions of normal performance. It does not provide warranty for defects if they occurred due to misuse, faulty care, tampering and alterations of components during repairs undertaken by unauthorized persons other than company’s authorized support technician or caused for erratic voltage supply for which the machine is not designed to sustain the load.
  10. The Customer shall not have any claim in respect of any personal injury, damage to property or consequential damages as a result of use not in accordance with Operating Manual. For the security equipment and systems provided by us, our aim is to protect you and greatly decrease the chances of any mishap but the final responsibility resides with the customer and as such Kawach will not entertain any claims for any mishaps or losses that happen on customer premises.
  11. The Parts / Spares are chargeable in case of any misuse, theft, physical damage or damage due to improper power surges, etc even if the machine is under warranty (AMC/CMC).
  12. Kawach does not undertake any responsibility for any verbal assurance given by the authorized agent on added benefits of service, spares, repair etc.
  13. The Customer is advised to register their complaints only on notified service numbers of the Company. The Company does owe any responsibility for any work/service obtained on personal contact number of worker of the company.
  14. By signing on the invoice page overleaf, you, the customer are agreeing to the charges and our terms and conditions. Even under AMC / CMC, when no charges are applicable the invoice slip needs to be signed and returned back to the service provider.
  15. Payments to be made via Cash, Cheque or NEFT to Kawach Protection Systems Pvt. Ltd. (IFSC: HDFC0000044 | A/C: 00442560000061).
  16. The legal jurisdiction for any disagreement or dispute on service or product shall be limited to Gurgaon jurisdiction only.

Turnkey Integration / Projects

The following Terms and Conditions are generally applicable for any integration projects undertaken in Kawach. They may change as per client requirements and will be clearly mentioned on each estimate and invoice sent to the client.

1) Payment Terms: 100% Advance. Pay-As-You go options available. Please discuss with your authorised sales representative.

2) Pricing is inclusive of applicable taxes. Shipping and Insurance extra as per actual.

3) Product Warranty: 1 year or as per manufacturer. Conduits, Wires, Cables, Batteries and Consumable are not under warranty.

4) Service Warranty: 1 month complimentary Bronze AMC after systems handoff to client. Kawach annual maintenance contracts (AMC) will be required for extending servicing and maintenance coverage after the complimentary grace period.
